Terms of Service

Welcome to GamerVault. These Terms of Service ("Terms") govern your use of the GamerVault mobile application and the website at gamervault.app (together, the "Service") operated by Mena Hanna ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use GamerVault. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the consent of a parent or guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials;
• All activity that occurs under your account;
• Notifying us promptly of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms, impersonate others, abuse the Service, or are dormant for extended periods.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose;
• Impersonate any person, including other GamerVault users or staff;
• Upload content that is illegal, hateful, harassing, infringing, deceptive, or sexually explicit;
• Use automated tools, bots, or scrapers to extract data from the Service;
• Attempt to reverse engineer, decompile, or interfere with the Service;
• Resell, redistribute, or commercially exploit any part of the Service without our written permission.

4. User Content

You retain ownership of the content you add to GamerVault — your collection list, notes, photos of your own games, and similar. By adding content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display that content as needed to operate the Service (for example, to render your public profile to other users who view it).

You are solely responsible for the content you add. Do not upload photos or text you do not have the right to use.

5. Intellectual Property

The GamerVault name, logo, design, and original content are our property and are protected by copyright, trademark, and other laws. You may not use them without our prior written permission.

GamerVault is an independent collector tool. We are not affiliated with, endorsed by, or sponsored by Nintendo, Sony, Microsoft, Sega, Atari, or any other video game publisher, platform holder, retailer, or grading service. All game titles, cover art, console names, and related trademarks are the property of their respective owners and are referenced in the Service solely for the purpose of identifying items in your collection.

6. Pricing and Valuation Data

GamerVault displays market value estimates sourced from third-party providers (such as IGDB and PriceCharting) and from public marketplace listings (such as eBay). These values are estimates for informational purposes only and do not constitute an appraisal, offer to buy or sell, or financial advice. Actual sale prices may vary significantly based on condition, region, demand, and other factors. We make no warranty as to the accuracy, completeness, or timeliness of any pricing data.

7. Affiliate Links

GamerVault contains affiliate links to third-party retailers (including eBay, Amazon, and merchants in the ShareASale network). When you tap an affiliate link and complete a qualifying purchase, we may receive a small commission at no additional cost to you. Affiliate relationships do not influence the games, prices, or information shown in the app.

8. Third-Party Services

The Service integrates with third-party services including but not limited to Firebase (Google), IGDB (Twitch/Amazon), PriceCharting, Apple Sign In, Google Sign-In, eBay Partner Network, Amazon Associates, and ShareASale. Your use of those services is governed by their respective terms and privacy policies, not ours.

9. Subscriptions and Purchases

GamerVault is currently free to use. If we offer paid features or subscriptions in the future, they will be handled through Apple's App Store or Google Play in-app purchase systems and governed by those stores' billing terms. Refunds for in-app purchases must be requested through the platform store, not GamerVault.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PRICING DATA WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GAMERVAULT, ITS OPERATORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED CAD $100 OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless GamerVault and its operators from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time and delete your account from Settings → Account → Delete Account. We may suspend or terminate your access if you breach these Terms. Provisions that by their nature should survive termination — including ownership, warranty disclaimers, limitation of liability, and dispute resolution — will remain in effect.

14. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you in the app or by email. The "Last updated" date above reflects the most recent revision. Your continued use of the Service after a revision becomes effective constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any dispute arising under or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
